    The Indonesian Journal of Islamic Law (IJIL) publishes scholarly articles on Islamic law and Sharia Courts. This edition has been available online since December 31, 2024. All articles in this edition were written or co-authored by 17 authors from 5 continents (Asia, Africa, America, Australia, and Europe), representing 14 affiliates and 9 countries: Morocco, Turkey, Iran, the USA, France, Tunisia, Australia, the United Kingdom, and Indonesia. These institutions include prominent universities from Indonesia, such as UIN Kiai Haji Achmad Siddiq Jember, IAIN Kediri, IAIN Ponorogo, UIN Sayyid Ali Rahmatullah Tulungagung, and Universitas KH. Abdul Chalim, Mojokerto. Internationally, contributors hail from esteemed institutions like Université Sidi Mohamed Ben Abdellah De Fes, Istanbul University, University of Sayyed Jamaleddin Asadabadi, Yale University, Sorbonne University, Université Paris 1 Panthéon-Sorbonne, Zaytunah University, University of Queensland, and University of Exeter

    In the realm of Islamic family law, various perspectives continue to evolve to bridge justice, tradition, and the principles of maqasid al-shari’ah. From the analysis of polygamy permits in the Kediri Religious Court to child custody adjudication in domestic violence cases in the Banyuwangi Religious Court, each study highlights efforts to protect the vulnerable and uphold substantive justice. The qira’ah mubādalah approach inspires a redefinition of equality in husband-wife relations, while cross-cultural studies reveal how local identities, such as the kelakat tradition in Loloan Timur, can align with shari’ah values. On a global scale, debates on Islamic family law face challenges within the context of human rights and French republican values. Meanwhile, the regulation of marriage age in Indonesia exemplifies how justice and tradition must coexist in shaping an inclusive future. These studies invite us to delve deeper into how Islamic law can serve as a dynamic space for dialogue, where universal justice and local diversity converge to create harmony amidst the complexities of the modern era.

    In this issue, we explore a range of critical themes surrounding marriage and family life from both Islamic and local perspectives. Our discussions include the negotiation and adaptation processes within forced marriages, highlighting women's resistance to patriarchal norms, the concept of child custody following divorce through the lens of Islamic law, Islamic law and local traditions shaping the practice of Appasili marriage in Takalar Regency, Indonesia, and early marriage and domestic violence, particularly focusing on the complexities faced by the Jember Religious Court in granting marriage dissolution permissions. Through these diverse topics, we aim to provide a comprehensive understanding of how cultural, legal, and personal dynamics influence marital relationships and family law.

    The second edition of the IJIL journal delves into diverse and thought-provoking topics, including the sociological and Maqasid Shariah perspectives on endogamous marriage for Syarifah in the Arab village of Kademangan, Bondowoso; the reconstruction of contemporary Arab reasoning by Muhammad ‘Abed Al-Jabiri; the analysis of equality in the rights and responsibilities of husbands and wives based on Musdah Mulia’s perspective in renewing Islamic family concepts in Indonesia; the relevance of Al-Ghazali’s Maşlahah in the context of Indonesian fiqh; interfaith marriage in Indonesia viewed from an inclusive pluralist fiqh perspective; and the dual role of women in families from the perspective of Indonesian Muslim feminists.

    Unlike the previous edition, which was preceded by an inter-university conference featuring lecturers as speakers, this edition held a conference between postgraduate students from IAIN Jember and IAIN Purwokerto. The articles in this issue are published bilingually in English and Indonesian.

  • Dialektika antara nilai universal dengan local wisdom dalam teorisasi hukum Islam di Indonesia
    Vol. 1 No. 1 (2018)

    The first edition of the IJIL journal focuses on the study of Islamic law under the theme “Dialectics between Universal Values and Local Wisdom in the Theorization of Islamic Law in Indonesia.” This inaugural edition was preceded by a national conference forum, where selected papers presented by the speakers underwent a rigorous editing process before publication. The articles in this edition are published in three languages: Arabic, English, and Indonesian. With a fair double-peer review procedure, the IJIL journal invites scholars and researchers to explore this theme from various perspectives, including Maqasid al-Shariah, social, gender, power relations, and identity.
